    This week we learnt that the human rights protection for asylum seekers in our former colony Papua New Guinea are more protected by the PNG constitution than they would be in Australia. The PNG government has quickly moved not to change the law and constitution, but to make arrangements to close the centre and ask Australia to take back the asylum seekers. Already PNG lawyers are talking about claims for compensation for the unlawful detention, and rightly so.

    High Court not the answer to Nauru depravity

    Following Wednesday's High Court decision, the moral depravity of Australian funded offshore detention of asylum seekers, including children, is to continue. There is no joy to be found in our High Court applying a Constitution even more bereft of human rights protections than that of Nauru. It's time for our politicians to address the political and moral question: what purpose is actually served by sending this mum and her baby back to Nauru, when the boats have already stopped and will stay stop?

    Just when the ringing of the words 'I stopped the boats' had finally subsided and you were getting used to the idea of business agility and economic innovation as the key battlegrounds, who should pop back up but former Prime Minister and Culture Warrior in Chief, Tony Abbott. Abbott's Margaret Thatcher memorial speech — in which the words 'a hint of Thatcher about my government' were used with apparently no irony whatsoever — was a stunning example of revisionism, hubris, and confused ideology.

    Oppressing compassion in Europe and Australia

    When refugees walked into Europe, away from distant distress sites, their presence made the global issue visceral for Europeans. Australia doesn't have asylum seekers walking en masse through ordinary streets. Our border is one of established hatred. 'Stop the boats' policy denies ordinary Australians their compassionate impulse, and creates a history that our children will face judgement upon. It denies humanity's collective memory after World War II.

    A fortnight ago political conversation about asylum seekers had to do with turning back the boats, the links between terrorism and religious identity, exporting our Stop the Boats policy to Europe, the seductive dangers of compassion, and attempts to wedge other parties on the basis of their softness. Now it appears we have moved on, and for that Mr Abbott deserves our ungrudging gratitude, whatever side of politics we stand on.

    If you want to form government in Australia and if you want to lead the Australian people to be more generous, making more places available for refugees to resettle permanently in Australia, you first have to stop the boats. If you want to restore some equity to the means of choosing only some tens of thousands of refugees per annum for permanent residence in Australia from the tens of millions of people displaced in the world, you need to secure the borders. The untrendy truth is that not all asylum seekers have the right to enter Australia but that those who are in direct flight from persecution whether that be in Sri Lanka or Indonesia do, and that it is possible fairly readily (and even on the high seas) to draw a distinction between those in direct flight and those engaged in secondary movement understandably dissatisfied with the level of protection and the transparency of processing in transit countries such as Malaysia and Indonesia.     The world is gazing with astonishment at our single-minded way of dealing with people who come to us for protection. It is iconic, now that nations in the region have adopted it. The modern understanding of icons as embodying qualities people desire differs from the Byzantine approach in which traditional religious icons do not impress us with their dominance over their environment, but draw us to their eyes.

    Since the drowning of around 800 people on 19 April, politicians in the UK, France, Italy and Denmark have been suggesting that the European Union adopt our hardline asylum policy. Prime Minister Tony Abbott has advised the EU that 'only way you can stop the deaths is in fact to stop the boats'.     There are few things less palatable – or likely to persuade others to see your point of view – than public humiliation. This week, as Julie Bishop visits Tehran, there are already some signs that these lessons may not have been well learned.
